1.1A bill for an act

1.2relating to health; proposing an amendment to the Minnesota Constitution, article
1.3XIII, by adding a section; providing for freedom of choice in health care.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5 Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.6An amendment to the Minnesota Constitution is proposed to the people. If the
1.7amendment is adopted, a section shall be added to article XIII, to read:
1.8Sec. 14. Because all people should have the right to make decisions about their health
1.9care, no law shall be passed that restricts a person's freedom of choice of private health
1.10care systems or private health plans of any type. No law shall interfere with a person's
1.11or entity's right to pay directly for lawful medical services, nor shall any law impose a
1.12penalty or fine, of any type, for choosing to obtain or decline health care coverage or for
1.13participation in any particular health care system or health plan.

1.14 Sec. 2. SUBMISSION TO VOTERS.
1.15The proposed amendment must be submitted to the people at the 2010 general
1.16election. The question submitted must be:
1.17"Shall the Minnesota Constitution be amended to state that because all people
1.18should have the right to make decisions about their health care, no law shall be passed
1.19that restricts a person's freedom of choice of private health care systems or private health
1.20plans of any type? No law shall interfere with a person's or entity's right to pay directly
1.21for lawful medical services, nor shall any law impose a penalty or fine, of any type, for
2.1choosing to obtain or decline health care coverage or for participation in any particular
2.2health care system or health plan.

2.5 Sec. 3. ACTION BY LEGISLATURE AND GOVERNOR.
2.6If the constitutional amendment proposed in section 1 is approved by the people
2.7at the 2010 general election, the legislature and the governor must enact legislation to
2.8implement the constitutional amendment by July 1, 2011.
