IN THE LEGISLATURE OF THE STATE OF ALASKA
TWENTY-SIXTH LEGISLATURE - SECOND SESSION

A RESOLUTION
Proposing amendments to the Constitution of the State 1 ate of Alaska prohibiting passage of
2 laws that interfere with direct payments for health care services and the right to
3 purchase health care insurance from a privately owned company, and that compel a
4 person to participate in a health care system.
5 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:
6 * Section 1. Article I, sec. 15, Constitution of the State of Alaska, is amended to read:
7 Section 15. Prohibited State Action. (a) No bill of attainder or ex post facto
8 law shall be passed. No law impairing the obligation of contracts, and no law making
9 any irrevocable grant of special privileges or immunities shall be passed. No
10 conviction shall work corruption of blood or forfeiture of estate.
11 * Sec. 2. Article I, sec. 15, Constitution of the State of Alaska, is amended by adding a new
12 subsection to read:
13 (b) No law shall be passed that prohibits a person from or that penalizes a
14 person for making direct payment to a health care provider for tendering health care
15 services, or that prohibits or penalizes the purchase of health care insurance from a

1 privately owned health care insurance company. 1 any. Except for a health care system that
2 provides indemnity and medical benefits to injured workers, no law shall be passed
3 that compels a person, employer, or health care provider to participate in a health care
4 system or that penalizes a person, employer, or health care provider for declining to
5 participate in a health care system.
6 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of
7 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the
8 State of Alaska, and the election laws of the state.
